These Terms and Conditions apply to the sale of tickets for the heritage “Treno di Dante” and tourist packages offering transportation on the aforesaid heritage train and other additional services in a 24-hour period (excluding packages which include overnight services) by the company Il Treno di Dante s.r.l..
Il viaggio con il treno storico ed i servizi inclusi nei pacchetti di cui all’articolo che precede si effettuano con qualsiasi condizione meteo. Gli orari di partenza sono tassativi, imposti dal gestore della rete ferroviaria e la società Il Treno di Dante deve rispettarli. Il Treno di Dante s.r.l. non sarà quindi considerata responsabile nel caso in cui i passeggeri, presentandosi in ritardo rispetto all’orario di partenza previsto, non riescano ad usufruire del servizio.
I biglietti del treno storico ed i pacchetti di cui all’articolo 1 che precede non sono rimborsabili. Entro 72 ore dall’orario previsto della partenza è possibile modificare, per una sola volta, la data del biglietto e del pacchetto con l’applicazione di una penale pari ad Euro 10,00. I biglietti del treno storico ed i pacchetti sono nominativi. If passengers decide not to complete the whole journey on the ‘Treno di Dante’ and to alight at one of the intermediate stations, they shall be entitled to a refund from Il Treno di Dante of the cost of a ticket for a standard FS train to reach the final destination of the ‘Treno di Dante’. To obtain the refund, passengers shall: (i) notify the stewards on the train in plenty of time that they wish to alight at one of the intermediate stops; (ii) ask the stewards for a copy of the instructions to apply for a refund; (iii) follow the steps in the instructions and provide all the information requested. Passengers shall be responsible for any mistakes they make when applying for the refund or any incorrect information they may give. They shall also be responsible for purchasing any train tickets they may need to continue their journey and/or go back from the station where they alighted.
If journeys on the heritage train or the services included in the packages referred to in article 1 are cancelled for reasons beyond the control of Il Treno di Dante s.r.l., including force majeure, temporary unavailability of the railway line, mayoral decree and/or actions taken by other public authorities which make it impossible to run the train and/or services, passengers may change the date of their ticket or package free of charge, provided the service is available on the new date.
Il Treno di Dante s.r.l. non risponde di eventuali sostituzioni, per causa tecniche ovvero di forza maggiore, della locomotiva storica con altro mezzo non avente natura storica. Tali eventuali sostituzioni dipenderanno in via esclusiva dalle decisioni della Fondazione FS Italiane e/o di Trenitalia che gestiscono la linea ferroviaria ed il servizio di trasporto. In tale ipotesi, l’utente non ha diritto ad alcun rimborso sul prezzo.
Il Treno di Dante s.r.l. shall not be liable for any damage, delays, disruption and/or cancelled services due to causes beyond its control, including force majeure, temporary unavailability of the railway line, mayoral decree and/or actions taken by other public authorities which make it impossible to run the train.
If the heritage train arrives at its destination more than 120 minutes after its scheduled arrival time, passengers shall be entitled to request a refund of 10% of the price of the ticket or package from Il Treno di Dante s.r.l..
There are no restrictions to the amount of luggage passengers may take on the heritage train. Passengers are responsible for loading and unloading their luggage and looking after it. They will also be solely responsible for any damage caused by their luggage to property or people, including staff on the heritage train. Il Treno di Dante s.r.l. shall under no circumstances be liable for damage to and/or the loss of luggage and/or passengers’ belongings.
Passengers travelling with bicycles (or oversized luggage which cannot be stored in the passenger carriage of the train) must stow them in the designated carriage. Passengers shall be responsible for loading and unloading their bicycle/luggage. They shall be liable for their bicycle and any damage caused by it to other bicycles and/or property or people, including staff on the heritage train. Il Treno di Dante s.r.l. shall under no circumstances be liable for damage to and/or the loss and/or theft of bicycles.
Dogs, cats and other small pets may be taken on the train free of charge, except for special exceptions. Under no circumstances may animals allowed in the carriages occupy seats intended for passengers. If an animal causes a nuisance to the other passengers, the train staff will ask the owner to move to another free seat. All dogs, except guide dogs, must have a muzzle and must be kept on a lead; they must also have a certificate of registration on the canine registry which must be shown whenever requested by train staff and when purchasing tickets, where applicable. Owners are responsible for looking after their animals and are liable for any damage caused by their animals to property and/or people, including staff on the heritage train.
The contract entered into with passengers is governed by Italian law.
The parties forthwith undertake to amicably resolve any disputes which may arise in relation to this contract. If an amicable settlement is not reached, the Law Court of Bologna shall have sole jurisdiction over any dispute which may arise in relation to the interpretation, execution and validity of the contract.
The unique layout of the heritage train and the lack of equipped seats means it is physically impossible for passengers with wheelchairs or similar mobility devices to board and travel on the train.
By accepting these terms and conditions, in order to use the service, passengers declare under their own responsibility and are aware of the legal and criminal consequences in the event of false statement that:
they are not currently positive for COVID-19;
they are not currently subject to self-isolation and/or quarantine requirements in accordance with current COVID-19 regulations;
they have not had a temperature of over 37.5 degrees, cough, difficulty breathing, flu-like symptoms, conjunctivitis or diarrhoea in the 14 days prior to using the service;
they have not been in contact with anyone suffering from COVID-19 in the 14 days prior to using the service;
they have not been in contact with anyone in quarantine in the 14 days prior to using the service;
they have not visited areas considered to be at risk from the virus in the 14 days prior to using the service;
they have not been in contact with people from areas considered to be at risk from the virus in the 14 days prior to using the service;
they will comply with the rules on social distancing and the mandatory use of face coverings on board the heritage train and on the ground in the areas where required.

Il Treno di Dante has taken out civil liability insurance with Compagnia Assicurativa UnipolSai Assicurazioni (insurance policy number: 1/2572/319/178288354).
Il Treno di Dante is authorised to carry out travel agency/tour operator business (SUAP register no. 1691/2020).
Il Treno di Dante ha sottoscritto una protezione in caso d’insolvenza con Fondo Vacanze Felici s.c.a.r.l., con sede legale in Via Larga n. 6, Milano e con sede operativa in Corso Venezia n. 47, Milano, Tel 02-92979050, PEC fondovacanzefelici@pecspace.it.
